Reverse the Employment Support Allowance disability benefit cut

The House of Lords has been unable to stop a planned £30-a-week cut to disability benefits forced through by Government MPs. This will cripple those in receipt of these benefits, leaving many in literal poverty.

The government must reverse this decision. Lives are at risk.

Councils charging for support puts #carers wellbeing at risk

From time to time, every carer needs support to help them look after the person they are caring for.

Sometimes that will mean getting equipment installed in their home so that they can meet the needs of the person they support. Other times it might mean calling in home help so that they can keep up with their housework.

The importance of these services cannot be overstated. They mean that carers can provide the best support possible to their friend or family member whilst maintaining their own health.

Opposition Day Debate and disabled people

There was an Opposition Debate yesterday in the House of Commons – called by Labour on a motion to condemn the recent statement by Lord Freud about disabled people possibly working for less than the minimum wage. Lord Freud has since apologised and the motion was lost.

However for those of us who have been watching the debates on Welfare Reform since 2007 – it was chance to see how far in some ways we have come and how far in others  we haven’t moved forward at all.

For the first few years of welfare reform no one had a clue what it would be like in reality. All we had was Freud and James Purnell talking pure theory.

That has certainly changed. All MP’s now have a deluge of disabled constituents coming in to their surgeries, and they have found out what it is about. So the debate is finally informed amongst MPs. Yet still they do nothing.

Withdrawal of nighttime care breached disabled woman’s human rights

The European Court of Human Rights (ECtHR) has decided today (20 May 2014) that the withdrawal of nighttime care from Mrs McDonald by the Royal Borough of Kensington and Chelsea breached her human rights for a period of almost a year before proper care planning processes were completed. Steve Cragg QC and Steve Broach acted for Mrs McDonald in the domestic proceedings and the ECtHR, instructed by Disability Law Service.

The judgment in McDonald v UK is the first time that a breach of Article 8 ECHR, the right to respect for private and family life, has been identified by the ECtHR in a case concerning the provision of services or support to a disabled person. The ECtHR held that the withdrawal of nighttime care was an interference with Mrs McDonald’s right to respect for private life, and that for the relevant period this interference was ‘not in accordance with the law’ because of the admitted failures of the care planning in her case. Although the Court of Appeal found that care planning had not been carried out properly in that period, a finding upheld by the Supreme Court, none of the domestic courts considered this to be a breach of Article 8 ECHR.

An important aspect of the judgment is the focus on Mrs McDonald’s human dignity, and in particular the extension of the principles established in Pretty v UK, a case on assisted dying, to the arena of the provision of welfare support.

A further key finding by the ECtHR was that the withdrawal of nighttime care constituted a negative interference with Mrs McDonald’s Article 8 ECHR rights, which meant she did not need to establish any positive obligation to provide the support she was seeking. This is likely to be very helpful to future challenges to cuts to disabled people’s care packages, not least because any such cut which is implemented without a proper reassessment or care plan review is highly likely to involve a breach of Article 8.

Mrs McDonald has been awarded damages of 1,000 Euros by way of just satisfaction.

Care Act 2014: launch of care and support consultation

The Department of Health is seeking views on how local authorities should deliver the care and support reforms in the 2014 Care Act

The department is asking for views on the draft regulations and guidance for Part 1 of the 2014 Care Act.

The government has worked with individuals and organisations to develop the most comprehensive overhaul of care and support since 1948. The changes will make the system fairer and will mean people get better care.

Care and Support Minister Norman Lamb said:

Care and support is something that nearly everyone in this country will experience at some point in their lives. Our Care Act will make the system fairer by putting people in control of their care and limiting the amount anyone may have to pay for the support they need.

These regulations and guidance will help support councils in making these reforms a reality. We ask people to continue to share their views and experiences as part of this consultation to make sure we deliver real, lasting change for people across the country.

The draft regulations and guidance have been developed by working with expert groups, including users of care and support, local authority staff, voluntary sector organisations, social workers, and national representative bodies including those drawn from local government.

The consultation is open until Friday 15 August and centres on the changes that will come into effect from April 2015.

A further consultation on the reforms that come into effect from April 2016 – which include the cap on care costs – will take place this autumn.

July 4th DPAC Independent Living Day -party and picnic, London and around the country

DPAC is delighted to extend an open invitation to celebrate Independent Living Day with us on the 4th of July at the ‘Independent Living Tea Party ‘.

The party will begin at 2pm at the DWP, Caxton House in Tothill Street SW1. There will be fun & games, and entertainment; and of course, some civil disobedience.

We have come a long way since the demand for Independent Living was first made nearly 50 years ago. Then, as now, IL was our solution for how society supports disabled people to take our place as equals. For how society addresses inaccessible institutions, structures and process it created, which do more to disable people than their impairments ever could.

There are many strands of Independent Living, and all are under threat. Cuts to:

  • Support funding – such Social Care, the ILF & Disabled Students Allowance;
  • Education – in areas like the wholesale destruction of SEN Statements and the continued segregation of disabled children into ‘special’ schools;
  • Transport – the withdrawal of Taxi-cards, freedom passes and the halting of planned works to make infrastructure more accessible, amongst a host of other cuts combine to make disabled people second-class citizens in society.

But we have fought this fight before – and won. Our Disabled Peoples Organisations, legal gains and the policy victories we have won previously are testament to the (more…)

Submission from Independent Taskforce on Poverty and Disability

CarerWatch and Pat’s Petition welcome the Task Force Report (download document here). We fully endorse all the positive suggestions for enabling disabled people to get ready for and join the work force. It is to be celebrated that so many barriers to employment for disabled people can now be managed and overcome.

However the report is in danger of forgetting that in some cases Impairment does still Impair.  And that this has to be negotiated with employers who will face extra costs.   Supporting disabled people is only one half of the equation. Getting a job is a contract between two sides. Disabled people are one half of the contract and employers are the other half. The contract is negotiated through the mechanism of a competitive labour market which doesn’t favour impairment.   It isn’t sufficient to just be concerned with the disabled person. Government has to think about employers and examine how they relate to disabled people. (more…)

So what is the real problem?

ATOS were asked to test disabled people and find out if they were fit for work.

Sadly being able to do some work is not the same thing as being able to get a job.

 

The real world out there is a competitive labour market. Employers hire the candidate who convinces them that they will be the most productive and stand up to the most pressure. The candidate who is the fittest, gets the job. That’s the real world of getting a job.

But what should an employer do when they are asked to take on a disabled person whose impairments will bring extra costs to the employer? No-one even asks the question. It’s the elephant in the room that no-one talks about. They’ll talk about reasonable adjustments and enabling people to overcome the barriers to being productive, but can that work for everyone?

 

Until we start asking these questions, we won’t find the solution. Governments intervene in markets all the time to promote equality: but apparently not for disabled people.

 

So let’s move the focus away from disabled people.

Stop blaming them and putting all the pressure on them to be fit for work when we know they need to be fit to get a job.

Let’s move the spotlight on to employers and the labour market out there in the real world. And look for solutions there.
